JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under section 414 of I.P.C and under section 27 (b) (ii)/ 28 r/w section 36 of Drug and cosmetic Act. As per the prosecution case, the written report of Anit Kumar, A.S.I. of SSB submitted to Station House Officer of Jogbani Police Station is to the effect that on 31.07.2019 at 4.10 P.M., the police party was conducting vehicle check when a three wheeler tempo was intercepted from which, huge quantity of medicines were seized and apprehended co-accused disclosed that the seized medicines were handed over by co-accused Nazim Ansari and consignment was to be delivered to this petitioner and co-accused Md. Sadarul.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.9164 of 2023(2) dt.25-04-2023 2/2 case and she has no concern with the seized intoxicating medicines. She is only alleged to be intended purchaser. No incriminating article has been recovered from her possession. Learned counsel for the State opposes the prayer for bail. The petitioner is alleged to be involved in the purchase and sell of prohibited drugs. Petitioner has got three criminal antecedent.
Considering the fact that a huge quantity of prohibited items has been recovered from the petitioner and she has got three criminal antecedent, the prayer for pre-arrest bail of the petitioner is rejected.
