JUSTICE BIRENDRA KUMAR ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 409/420/467/468/471 of the Indian Penal Code. Allegation against the petitioner is that she produced forged and false information for getting promotion to the post of professor and was accordingly promoted. Submission of the petitioner is that Annexure-3 would reveal that the petitioner was allowed time bound promotion on 07.01.2000 in view of the provisions of Rule-19. Therefore, whole allegation is with mala fide intention to harass the petitioner. When the authority came to know this fact suspension of the petitioner has already been revoked. Learned counsel for the Vigilance opposed the prayer for anticipatory bail.

Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance-II, Patna/Successor Court in connection with Special Case No.33 of 2016, arising out of Vigilance P.S. Case No.90 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
