The petitioner seeks regular bail in connection with Nasriganj P.S.case No.226 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 18.900 ltrs. of liquor from the shop of the petitioner. Submission of the learned counsel for the petitioner is that the liquor was recovered from behind the Gumati of the petitioner and he is not owner of the same. Moreover, he is in custody for three months. Charge sheet has already been submitted and he is ready to co-operate in the disposal of the trial. He has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District and Sessions Judge cum Special Judge, Excise, Rohtas at Sasaram in connection with Nasriganj P.S.case No.226 of 2019. With the aforesaid observation, this application is allowed.
