The petitioner seeks bail in Sessions Trial No. 555 of 2014 arising out of Teghra P.S. Case No. 27 of 2014, registered under sections 457, 354(B), 366(A) and 376 of the Indian Penal Code.
It has been contended that the victim has categorically stated in her statement recorded under section 164 of the Code of Criminal Procedure that no physical relationship was established by the petitioner with her. Referring to the findings of the trial court, as recorded in paragraph no.5 of the impugned order, it has been submitted that the petitioner and the daughter of the informant were close friends and they talked each other times
Patna High Court Cr.Misc. No.4451 of 2015 (2) dt.25-03-2015 2 / 2 without number on phone between 24-1-2014 and 30-1-2014. The Supervising Officer of the case has found the case to be true for the offence punishable under section 376/511 of the Indian Penal Code. It has further been contended that by now the petitioner has remained in custody for over one year.
Learned counsel for the State has opposed the prayer for bail.
Regard being had to the facts and circumstances of the case, the above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Begusarai, in connection with Sessions Trial No. 555 of 2014 arising out of Teghra P.S.Case No. 27 of 2014 dated 30-1-2014.
