JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 11-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. Learned counsel for the petitioner is directed to remove the defects, as pointed out by the office, within a period of four weeks.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 307, 379, 147, 148 & 149 of the Indian Penal Code. The allegation against the petitioner, as per the first information report, is that the petitioner along with other coaccused persons reached near the private bus sand when the informant had to start his bus from counter no.1, the same as

No.12165 of 2021(2) dt.11-01-2022 2/3 objected thereupon by the staff of Shiv Ganga Bus and other accused persons along with the petitioner came with danda, rod, farsa and started to abuse the informant and on objection one Sandeep Yadav assaulted with farsa near the neck of the informant from the back side.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The specific allegation is against Sandeep Yadav. Petitioner has no criminal antecedent. Similarly situated co-accused, namely, Pappu Sinha @ Pawan Kumar Sinha has been enlarged on bail by a co-ordinate bench of this court vide order dated 04.09.2019 passed in Cr. Misc. No. 55619 of 2019. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Kotwali (Tilkamanjhi) P.S. Case No. 110 of
