JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section-30(a) of the Bihar Excise (Amendment) Act, 2016.
It is submitted that three bottles of foreign liquor have been seized from a bag found in possession of the petitioner. It has been submitted that the petitioner is in judicial custody since 31121-2016. It is mentioned at paragraph-3 of the petition that the petitioner has got no criminal antecedent.
Keeping in view the period of detention of the petitioner in jail custody as also, his fair antecedent let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.4394 of 2017 (2) dt.13-02-2017 2/2 amount each in connection with Excise Case No. 235 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Bhabua (Kaimur) subject to condition that both the bailors will be close relatives of the petitioner.
