Petitioner apprehends arrest in connection with Mahua P.S. Case No. 393 of 2022 registered for the offence punishable under sections 414/34 of the Indian Penal Code and Sections 30(a)32 (ii), 34(ii), 38(ii), 41(i) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from the land of one Mukesh Rai, as is evident from the seizure list. Petitioner has no concern with the seized article.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.4335 of 2023(3) dt.19-05-2023 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II-cum-Special Judge, Excise, Vaishali in connection with Mahua P.S.
