JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bheldi P.S. Case No. 227 of 2017 registered under Sections 188, 272, 273/34 of the Indian Penal Code and Section 30, 30(a) of the Bihar Prohibition and Excise Act.

On receiving secret information about carrying illicit liquor loading on a white colour Maruti car, checking was made and the alleged car was stopped. On search 240 litres of country made liquor recovered from the car while petitioner and two other started to flee away but they were apprehended by the informant and other police official.

Learned counsel for the petitioner submits that neither

Patna High Court Cr.Misc. No.7340 of 2018 (2) dt.08-02-2018 2/2 the petitioner is owner of the car nor he has any concern with the alleged recovery. In fact real culprit succeeded in fleeing away but the petitioner was apprehended on mere suspicion and the petitioner having no criminal antecedent and is in custody since 17.12.2017.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, 6th, Saran at Chapra, in connection with Bheldi P.S. Case No. 227 of 2017. Out of two sureties, one surety must be the close relative of the petitioner.
