NILU AGRAWAL ORAL ORDER 17-01-2019 Heard the learned counsel for the petitioner and the learned counsel for the State and learned counsel appearing on behalf of Baba Saheb Bhim Rao Ambedkar Bihar University, Muzaffarpur as well as the counsel for the Jai Prakash University, Chapra.

Petitioner retired from the post of Reader, Department of Philosophy, Jagdam College, Chapra, Saran with effect from 31.01.2001 under the Baba Saheb Bhim Rao Ambedkar Bihar University, Muzaffarpur.

Patna High Court CWJC No.1197 of 2019(2) dt.17-01-2019 2/2 Petitioner in the present writ application claims payment of his gratuity, earned leave, dearness allowance at the government rate and difference of revised salary as per the revision in view of the order passed in MJC No.153 of 2006 dated 15.09.2006. He submits that group insurance has also not been calculated and paid at the admissible rate. Considering the nature of claim made by the the petitioner, this writ application is disposed of with a liberty to the petitioner to file a fresh representation before the respondent no.4, the Registrar, Baba Saheb Bhim Rao Ambedkar Bihar University, Muzaffarpur or the respondent no.

7 the Registrar, Jai Prakash University, Chapra along with all the calculations under different heads which is due to him, which will be disposed of either by the respondent nos.4 or 7 within a period of three months from the date of receipt of such representation. Any amount due to the petitioner would be paid within two months thereafter. If certain amounts are not admissible, the same would be communicated to the petitioner by a speaking order through registered post.
