The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. When the informant was returning after recovering the installments of company, three unknown motorcycle riders, on the point of pistol, snatched his bag which contained money, documents and mobile phone.
Learned counsel for the petitioner submits that petitioner is innocent, not named in the FIR and has been falsely implicated in this case. He submits that nothing has been recovered from the conscious possession of the petitioner. He submits that the petitioner has been made accused in this case on the confessional statement of co-accused. He submits that charge-sheet has already been submitted and there is allegation
Patna High Court CR. MISC. No.13413 of 2021(3) dt.27-09-2021 2/2 of tampering with the prosecution witnesses by the petitioner. He further submits that petitioner bears one criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since18.08.2020.
Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sherghati P.S.
