ANJANA MISHRA ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 31.1.2014 in Dumraon P.S. Case No.150/13 for the offence under Sections 302, 307/34 of I.P.C. and Section 27 of the Arms Act. It is submitted on behalf of the petitioner that initially the case was registered against unknown but subsequently on the basis of confessional statement of one Golu Tiwary, one Dhiraj Mishra was arrested in this case and subsequently Dhiraj Mishra also gave confessional statement implicating this petitioner in the present case.

Considering the aforementioned submissions and also the fact that the confessional statement made before the police

Patna High Court Cr.Misc. No.11082 of 2014 (3) dt.09-01-2015 2/2 has no evidentiary value and also that similarly situated Golu Tiwari @ Golu Tiwary has been extended the privilege of bail by a coordinate Bench vide order dated 17.12.2014 passed in Cr.Misc. No.36918/14, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Buxar, in Dumraon P.S.Case No.150/13.
