JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 30(a)(d) of the Bihar Prohibition and Excise Act.

Prosecution case is that 200 liters soaked Mahua was recovered from the house of the petitioner.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case because she is wife of co-accused Birendra Chaudhari from whose house the said recovery has been made. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is a lady and has got no criminal antecedent.
