The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Section 366(A)/34 of the Indian Penal Code.

As per allegation, co-accused Jiwach Sada abducted the daughter of the informant, namely, Khushbu Kumari. When informant along with villagers reached at the house of co-accused Jiwach Sada to inquire about her daughter, accused persons assaulted her.

No.3776 of 2024(2) dt.01-02-2024 2/3 It is submitted by learned counsel for the petitioner that the petitioner is innocent and she has falsely been implicated in the present case. There is no specific overt act of allegation against the petitioner rather the specific allegation of abduction of informant's daughter is levelled upon co-accused Jiwach Sada. Moreover, the petitioner is languishing in judicial custody since 01.09.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, petitioner being a lady as well as period of custody, this Court is inclined to enlarge the petitioner on bail.
