JUSTICE ARUN KUMAR JHA ORAL ORDER 19-04-2025 Learned counsel appearing on behalf of the National Investigating Agency (for short 'the N.I.A.') submits that the present petition is not maintainable before this Court since the N.I.A. has taken over the matter and the petitioner should first approach the Special Court of N.I.A. seeking bail and if the bail is rejected in that case, an appeal would lie before the Division Bench of this Court and the learned Single Judge is not empowered to hear the bail petition. Learned counsel further submits that the matter is being investigated by the N.I.A. Court and the orders are required to be passed by the Special Court of N.I.A.

2. Faced with the situation, learned counsel for the petitioner seeks permission to withdraw the present petition to approach the Special Court of N.I.A.

3. Permission is accorded.

4. Accordingly, the present petition is dismissed as withdrawn with liberty as aforesaid.
