The petitioner is languishing in custody since 30.11.2014 in a case registered for the offences punishable under Sections 341, 342, 395 of the Indian Penal Code and 27 of the Arms Act.

The accusation is of robbing the tractor of the informant leading to the registration of FIR against six unknown persons.

The name of the petitioner sprang up during investigation on the confession of co-accused Wajid Hussain, but neither there is any recovery from the petitioner nor the petitioner

Patna High Court Cr.Misc. No.13149 of 2015 (02) dt.07-04-2015 2/2 has been identified by the informant while he was put on TIP. The informant also failed to identify co-accused Wajid Hussain on whose confession the petitioner's complicity sprang up and Wajid Hussain has been granted bail vide Cr. Misc. No. 11030 of 2015. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Paharpur P.S. Case No. 309 of 2014.
