JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-02-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code. Earlier the petitioner was on bail but he made absent himself from the proceeding as a result whereof charge could not be framed and his bail bond was cancelled sometime in the year 2016. However, subsequently, petitioner was arrested and produced before the trial court on 06.10.2018 and since then he is languishing in jail custody.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this petition stands disposed of with direction to trial court to release the petitioner on bail in

Patna High Court Cr.Misc. No.4301 of 2019(2) dt.13-02-2019 2/2 connection with K. Hat P.S. Case No. 486 of 2014 fixing the amount of bail bonds on its own level after framing of the charge in the said case.
