The petitioner seeks bail in a case registered under Section 307 and other sections of the IPC.
The petitioner is alleged to have assaulted informant Hatik Khan. The doctor found one incised would on his head. The nature of injury is opined to be grievous in nature.
It is submitted that the occurrence took place due to land dispute for which the petitioner has filed a case. During the course of investigation, the witnesses have stated that both sides were pelting stones. The doctor found L shaped incised injury on head of the informant which can not be caused by sword. There is no repeation of blow. Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri D. Vasistha, Judicial Magistrate, Siwan in connection with Andar P.S.Case No. 82 of 2014.
