The petitioner is in custody since 06.09.2015 in connection with Runnisaidpur P.S. Case No. 396 of 2013 registered for an offence under Sections 302/34 of the Indian Penal Code, 27 of the Arms Act and 17 of the Criminal Law Amendment Act.

The prosecution case is that the informant along with his cousin brother were surrounded when they are taking tea at the tea stall and the accused persons surrounded them and fired upon the cousin brother of the informant, namely, Feku Yadav, due to which he received fire arm injuries and sent to Muzaffarpur hospital for treatment.

Learned counsel for the petitioner submits that the petitioner is in custody since 06.09.2015. Charge sheet has been submitted in the case. There is no criminal antecedent against the petitioner as well as no tampering of witness alleged against the petitioner. No specific injury has been attributed against the petitioner and other co-accused have been granted bail vide

Patna High Court Cr.Misc. No.24514 of 2016 (4) dt.17-08-2016 Annexures 2 and 3 to the present application. On behalf of the State, it is submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Runnisaidpur P.S. Case No. 396 of 2013 to the satisfaction of the Chief Judicial Magistrate, Sitamarhi.
