JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-02-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially registered for the offence punishable under Section 394 of the Indian Penal Code and later on Section 412 of the I.P.C. was also added. Petitioner was earlier on bail but his bail bond was cancelled as he failed to appear before the trial court and due to non-appearance of the petitioner charge could not be framed. However, learned trial court cancelled the bail bond of the petitioner on 03.11.2016 and thereafter, he could be arrested and remanded on 04.10.2018.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this petition stands disposed

Patna High Court Cr.Misc. No.4976 of 2019(2) dt.13-02-2019 2/2 of with direction to trial court to release the petitioner on bail in connection with Purnea Sadar P.S. Case No. 321 of 2014 fixing the amount of bail bonds on its own level after framing of the charge in the said case.
