JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 504, 323, 324, 307, 379/34 of the Indian Penal Code.

It is alleged that on the date and time of occurrence, all the F.I.R named accused persons including this petitioner abused and assaulted the informant as a result of which informant and her son sustained injuries.

Learned counsel for the petitioner submits that the specific allegation of assault is against the co-accused person named as Md. Ulfat. There is also a land dispute between the parties. Petitioner has falsely been implicated in this case due to village politics. He further submits that earlier a case being Biraul P.S. Case No. 151 of 2022 was instituted by the petitioner

Patna High Court CR. MISC. No.2014 of 2023(2) dt.11-04-2023 2/2 against informant and his son for the offence u/s 341, 323, 504, 354B, 379, 324, 308, 34 IPC and to save skin from the case the informant dragged the petitioner in this false case. Petitioner claims clean antecedent.

Learned counsel for the State opposed the bail petition.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Chief Judicial Magistrate-I Biraul, Darbhanga in connction with Biraul, P.S. case no.255 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
