2. In the instant petition, the petitioners are challenging the order dated 01.04.2017 passed by the learned District Judge, Bhagalpur in Misc. Transfer Case No.08 of 2017.
3. The petitioners filed the aforesaid petition for transfer of Title Appeal No.149 of 2014 pending in the court of learned 2nd Additional District Judge, Bhagalpur to any other court on
Patna High Court C.Misc. No.795 of 2017 dt.11-01-2024 2/2 the ground that the learned Judge has come in collusion with the opposite parties, who were claiming that final order would be passed in their favour. The aforesaid misc. petition was dismissed by the learned District Judge, Bhagalpur holding that it was neither believable nor acceptable. The said order dated 01.04.2017 is under challenge before this Court.
4. Perused the record.
5. Since more than six years have elapsed and the matter must have gone from one court to another, keeping the matter pending before this Court is nothing but wastage of precious time of this Court. Even the order passed by the learned District Judge does not suffer from any infirmity since the allegations itself were contemptuous.
6. Therefore, I do not find any merit in the instant petition and the same is dismissed.
