The petitioner apprehends his arrest in C.R. No.238 of 2019 registered under Section 498A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has committed no offence and has falsely been implicated in the present case. Petitioner is the husband of the complainant. The complainant made a memorandum before Sarpanch Harpur Barheta stating that she left the house of her husband with her all belongings at her own wish and there is no grievance against her husband and his family members as is evident from Annexure 3 to this application. Having considered the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned Sub-Divisional Judicial Magistrate, Samastipur in connection with C.R. No.238 of 2019, T.R. No.3460 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
