JUSTICE SUDHIR SINGH ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 379 of the Indian Penal Code.

It is alleged by the informant that on 18.11.2015 he has left his motor cycle in front of Sadar Hospital, Bhabua and went in the hospital to see his patient and when he came back found missing his motorcycle.

It is submitted on behalf of the petitioner that the petitioner is in custody since 14.04.2016. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering of the witnesses against the petitioner. The petitioner is not named in the FIR. He has not been put on T.I. parade. The petitioner has no knowledge

Patna High Court Cr.Misc. No.24325 of 2016 (4) dt.08-08-2016 2/2 that the motor cycle, in question, is a stolen property. On behalf of the State, it is submitted that the petitioner is not named in the FIR.

Considering the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua in connection with Bhabua P.S.Case No. 650 of 2015,G.R.No. 2675/2015.
