JUSTICE SHIVAJI PANDEY ORAL ORDER 25-04-2017 Today, a supplementary affidavit has been filed on behalf of the petitioner where in paragraph 4, it has been mentioned that the petitioner is ready to liquidate the amount of Rs. 26,93,843/-, which is a disputed amount, within a period of six months and he will pay the rest amount after adjudication of the dispute by the Arbitrator.
The aforesaid amount was required to be paid, but the petitioner has failed his liability by making payment. Looking to the facts and attending circumstances, this Court grants four months' time to the petitioner to deposit the
Patna High Court CWJC No.2704 of 2017 (5) dt.25-04-2017 2/2 aforesaid amount in four equal instalments, but the first instalment should be deposited within 20 days from today. In failure, the Bihar State Food and Civil Supplies Corporation Ltd. will have liberty to act in accordance with law.
If the petitioner deposits the first instalment within 20 days, upto four months no coercive steps will be taken against the petitioner in connection with Certificate Case No. 07/2014-15, notice dated 21.11.2014 (Annexure-3) and operation of warrant of arrest dated 13.04.2016 (Annexure-7) is kept in abeyance. With the above observation/direction, this petition is disposed of.
