JUSTICE PARTHA SARTHY ORAL ORDER 20-07-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Pipra P.S. Case no.166 of 2020 registered under section 395 of the Indian Penal Code. As per allegation in the F.I.R, six accused persons on two motorcycles looted the petitioner of his belongings, details of which have been given in the F.I.R.
It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. In course of investigation co-accused Sanjeet Kumar confessed his guilt of having given effect to the occurrence with the assistance of the other accused persons including the petitioner herein as also one Rupesh Kumar. It is submitted that the said Rupesh Kumar has been enlarged on bail vide order dated 8.7.2021 passed in Cr.
Patna High Court CR. MISC. No.11932 of 2021(2) dt.20-07-2021 2/2 Misc. no.14379 of 2021. The petitioner has not been put on T.I. parade. He is in custody since 4.7.2020 and has no criminal antecedent.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner not having been put on T.I. parade inspite of being in custody for more than one year, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Pipra P.S. Case no.166 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul.
