The petitioners seek bail in Ghoghardiha P.S. Case No. 86 of 2013 dated 19.09.2013 instituted for offence punishable under Sections 302/120B/34 of the Indian Penal Code and 27 of the Arms Act.

This is the second attempt of the petitioners for bail as earlier such prayer was rejected by order dated 14.07.2014 in Cr. Misc. No. 7378 of 2014.

Learned counsel for the petitioners submits that in the trail only one prosecution witness now remains to be examined. In view of the aforesaid, the Court is not inclined to

Patna High Court Cr.Misc. No.11697 of 2015 dt.01-07-2016 2/2 consider the prayer for bail considering the stage of the trial, which is likely to be concluded soon.

The application accordingly, stands dismissed. However, the Court below is directed to ensure that the remaining prosecution witness, as per the submission of learned counsel for the petitioners, is examined within two weeks and thereafter the case shall be taken to its logical conclusion by passing final judgment expeditiously.
