JUSTICE SUDHIR SINGH ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 302 and 201/34 of the I.P.C. The allegation is that the petitioner in conspiracy with other co-accused committed murder of Abhimanyu Singh, A.S.I. posted at Jhajha Rail P.S.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.2.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. He is A.S.I. posted at G.R.P. In paragraphs 165, 166, 167, 170 and 171 of the case diary it has been stated that the deceased is said to have met accident

Patna High Court Cr.Misc. No.29420 of 2016 (3) dt.03-10-2016 with a train and because of that he had died. The other co-accused have been granted bail vide Cr.Misc.No.31447 of 2016 and Cr.Misc.No.13624 of 2016.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Lakhisarai in connection with S.T. No.138 of 2016 arising out of Jhajha Rail P.S. case No.17 of 2010. (Sudhir Singh, J) Narendra/- U T
