JUSTICE SUDHIR SINGH ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 366 and 366(A) of the Indian Penal Code. The prosecution story, in brief, is that the daughter of the informant, namely, Reshmi Kumari aged about 16 years on 16.07.2015 at about 7.00 had gone to Sachdeva coaching at Aurangabad but she did not return back. It is further alleged that this petitioner on previous day had snatched the mobile of the victim and also behaved indescently with her. It is submitted on behalf of the petitioner that the petitioner is in custody since 13.04.2016.Charge sheet has been submitted in this case. There is no allegation of tampering of the witnesses against the petitioner. The case has been instituted on
Patna High Court Cr.Misc. No.24444 of 2016 (4) dt.08-08-2016 2/2 19.07.2015 The delay of instituting the case has not been explained by the prosecution. As per statement of the victim recorded under Section 164 Cr.P.C. there is no allegation of sexual abuse (Annexure 3). The case has been compromised between the parties.
On behalf of the State, it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Aaurangabad (Town) P.S.Case No. 300 0f 2015.
