JUSTICE PARTHA SARTHY ORAL ORDER 15-07-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Supaul P.S. Case no. 128 of 2020 registered under sections 8 and 20(b)(II)(B) of the NDPS Act.

As per allegations in the F.I.R., on a raid being conducted it is stated that 7.138 kgs of ganja was recovered from the possession of the father of the petitioner. It is stated that the father of the petitioner disclosed that the petitioner also worked with him.

It is submitted by learned counsel for the petitioner that the allegation of recovery is false and concocted. There is no material against this petitioner except the statement of his

Patna High Court CR. MISC. No.11859 of 2021(2) dt.15-07-2021 2/2 father made before the police. Co-accused Devendra Shah has been enlarged on bail vide order dated 11.9.2020 passed in Cr. Misc. no. 22441 of 2020. The petitioner has no criminal antecedent and is in custody since 28.8.2020. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Special Case no. 3 of 2020 (arising out of Supaul P.S. Case no. 128 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 1st-cum-Special Judge, Supaul.
