The petitioner seeks bail in Vigilance P.S. Case No. 09 of 2017 registered under Sections 7 and 13(2) read with Section 13(1)(D) of the Prevention of Corruption Act corresponding to Special Case No. 06 of 2017.

One Chandrashekhar Kumar complained that the petitioner demanded Rs. 10,000/- for payment of the retiral benefits after the death of Punam Kumari.

Leanred counsel for the petitioner submits that Lal Babu Singh is the husband of the deceased Punam Kumari. The complaint was made by Chandrashekhar kumar on 31.01.2017, but before that day, more than Rupees 11 lakhs has been credited into the account of Lal Babu Singh, the husband of the deceased

Patna High Court Cr.Misc. No.18775 of 2017 (2) dt.26-04-2017 2/2 Punam Kumari. The petitioner is in jail since 31.01.2017. Chargesheet has already been submitted.

Learned counsel for the vigilance vehemently opposed the prayer for bail. It appears that the petitioner has already remained in jail for three months for recovery of Rs. 10,000/- from his possession. It is alleged to have taken by the petitioner for payment of retiral benefits after the death of Punam Kumari.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance, North Bihar, Muzaffarpur in connection with Special Case No. 06 of 2017 arising out of Vigilance P.S. Case No. 09 of 2017.
