The petitioner is languishing in custody since 09.12.2014 in a case registered for the offences punishable under Sections 302 of the Indian Penal Code and 27 of the Arms Act. Informant received information on 14.08.2014 at 0.15 P.M. that someone has shot his brother, consequently the informant went to find the dead body of his brother with firearm injuries leading to the registration of the FIR against unknown. The name of the petitioner sprang up on the statement of hearsay witnesses, whose statement has been recorded in paragraph nos. 49, 50 and 58 of the case diary.

Patna High Court Cr.Misc. No.13161 of 2015 (02) dt.07-04-2015 2/2 Paragraph 58 of the case diary contains the confessional statement of Md. Rizwan, who suggested the complicity of the petitioner and considering the suspicious nature of accusation Md. Rizwan has been granted bail vide Cr. Misc. No. 4172 of 2015. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali P.S.
