JUSTICE SUDHIR SINGH ORAL ORDER 11-06-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Parasbigha P.S. Case No. 156 of 2014 for the offences instituted under sections 302/34 of the Indian Penal Code and section 3(2)(v) of the S.C./S.T. (Prevention of Atrocities) Act. The prosecution story, in brief, is that deceased Mithilesh Manjhi was suffering from mental disorder. He on the night of 27.12.2014 all of a sudden left his house and at 1.00 A.M. it was known that the deceased was being mercilessly assaulted by Khanti and lathi by the petitioner and others calling him as thief. The deceased succumbed to the injuries later on. It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.16557 of 2015 (2) dt.11-06-2015 that there is general and omnibus allegation against the petitioner. No specific injury has been attributed against the petitioner. Petitioner is a man of clean antecedent and he is in custody since 29.12.2014.

On behalf of the State it has been conceded that there is general and omnibus allegation against all the accused persons.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Jehanabad in connection with Parasbigha P. S. Case No. 156 of 2014.
