Petitioner is languishing in custody since 15.07.2014 in a case registered for the offences punishable under Sections 302, 328, 376, 120B/34 of the Indian Penal Code It is alleged that the petitioner established physical relationship with the daughter of the informant on promise of marriage and thereafter the family members of the petitioners refused to marry, as a result the petitioner killed the victim and threw the dead body in a field. It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled and on conclusion of the investigation charge-sheet has

Patna High Court Cr.Misc. No.12833 of 2015 (3) dt.30-06-2015 been submitted under Section 306 of the Indian Penal Code. Since the post-mortem report reflects no apparent injury on the dead body. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Motihari, East Champaran in connection with Dumariya Ghat P.S. Case No. 27 of 2014.
