Petitioner seeks bail in Kurhani P.S. Case No. 438 of 2014 registered under sections 328, 302 of the Indian Penal Code.
The informant alleged that the petitioner took his wife and daughter for treatment. But on the next day he got information that his wife was killed. The daughter of the deceased disclosed that the petitioner gave poison to the wife of the informant. Learned counsel for the petitioner submits that he happens to be relative of the victims as well as the informant. The petitioner has got no motive to kill her. The deceased might have taken poison. But from perusal of the first information report it appears that the Anshu Priya daughter of the deceased
Patna High Court Cr.Misc. No.9384 of 2015 (4) dt.07-05-2015 2/2 who is seven years old disclosed that petitioner administered poison. The viscera report is preserved for analysis. Viscera report shows death due to poisoning.
Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail. The same is rejected. The trial court is directed to expedite the trial and conclude the same within one year from the date of receipt/production of a copy of this order. If the trial is not concluded, the petitioner may renew his prayer for bail after one year.
