In this case, the petitioner is seeking regular bail in connection with Gaurichak P.S. Case No. 510 of 2022, registered for the offenses punishable under Sections 366-A of Indian Penal Code and 8, 12 of POCSO Act.
Learned counsel for the petitioner has submitted that though there is allegation of kidnapping of minor daughter of the informant against the petitioner but the victim herself has stated that she went to Surat along with the petitioner who is cousin brother and they returned to their home. It appears that the victim did not make allegation against the petitioner in her statement under Section 164 of the
Patna High Court CR. MISC. No.2169 of 2023(3) dt.24-04-2023 2/2 Cr.P.C. The petitioner is under custody since 06.08.2022. He is a person of clean antecedent.
Considering the above-mentioned facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VII cum exclusive Special Judge (POCSO) Act, Patna in connection with Gaurichak P.S. Case No. 510 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
(ii) If the petitioner is found involved in future in the similar type of offense, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
