JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2015 Heard learned counsels for the petitioner and the State. The petitioners are languishing in jail since 13.12.2014 in a case registered for the offences punishable under Sections 366A and 120B of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that in 164 cr. P.C. statement, the victim got her age recorded as 15 years when the court assessed as such where she stated that when went to her parental aunt house after fighting with her mother and the case has wrongly been instituted. Though, the parental aunt of the victim has not supported the factum of the victim going to her house.
