====================================================== CORAM: HONOURABLE MR. JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner. Despite repeated calls, none appears on behalf of the State. The petitioner seeks bail in connection with Kanti P. S. Case No. 40 of 2013 registered under Sections 304-B and 201/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that it would be evident from perusal of the FIR itself that the informant had participated in the funeral and ritual of her deceased daughter. The matter was not reported to the police for almost two months and after about two months, on 4th February, 2013, for the alleged death of the daughter of the informant, a false and concocted FIR was lodged against the

Patna High Court Cr.Misc. No.35159 of 2016 (2) dt.20-08-2016 2/2 petitioner. It is also submitted that for no fault on his part, the petitioner is languishing in custody since 29th March, 2016. Regard being had to the submissions made at the Bar, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned SDJM, West, Muzaffarpur in Kanti P. S. Case No. 40 of 2013.
