The petitioners are languishing in custody since 30.01.2015 in a case registered for the offences punishable under Sections 302 and 120B of the Indian Penal Code. One Rahul Kumar tenant of the petitioners has committed suicide leading to registration of U.D. Case No. 01 of 2014. During post-mortem injury was found when F.I.R. was registered on 15.06.2014 against unknown. The name of the petitioners sprang up during investigation when father of the victim filed an application on 07.06.2014 raising doubt about the
Patna High Court Cr.Misc. No.11058 of 2015 (03) dt.31-03-2015 2/2 complicity of the petitioners. Some of the witnesses have also raised suspicion against the petitioners, though, it was found that some girl talked with the victim prior to his committing suicide. It is submitted by learned senior counsel for the petitioners that only on suspicion the accusation has been levelled after more six months of the death of the victim. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S. Case No. 365 of 2014.
