JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-08-2022 Though, the present writ petition was filed for restraining the respondents from proceeding further in the ongoing Encroachment Case No. 21 of 2015-16, pending before the Circle Officer, Sadar, Darbhanga i.e. the Respondent no. 3, however, the Respondents have filed a counter affidavit and brought on record the entire order sheet of the aforesaid proceedings bearing Encroachment case No. 21 of 2015-16 from which it is apparent that the final order u/s 6(1) of the Bihar Public Land Encroachment Act, 1956 has already been passed.
In such view of the matter, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to assail the aforesaid final order passed by the Respondent no.3 by filing
Patna High Court CWJC No.1354 of 2018(3) dt.01-08-2022 2/2 appropriate appeal. Liberty so sought is granted. The writ petition stands disposed of with aforesaid liberty.
