The petitioner seeks bail in anticipation of his arrest in connection with Shahkund P.S. Case No. 288/2017 instituted for the offences under Sections 143, 341, 323, 307, 447 and 504 of the Indian Penal Code.

The accusation against the petitioner is of abusing and assaulting the informant by means of a bhala resulting in head injury to him.

The learned counsel for the petitioner has submitted that the injury is simple, caused by hard and blunt substance. He has falsely been implicated in this case

Patna High Court CR. MISC. No.12270 of 2021(2) dt.23-12-2021 2/2 because of a dispute between the neighbours.

Seeing the futility of further prosecution of the petitioner, the informant has chosen not to prosecute the petitioner any further.

The other accused person of this case has been granted anticipatory bail by a Bench of this Court. Regard being had to the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bhagalpur, in connection with Shahkund P.S. Case No. 288/2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
