The petitioner nos. 1 to 4 are languishing in custody since 30.01.2015 and petitioner nos. 5 to 7 are languishing in custody since 06.11.2015 in connection with Imamganj P.S. Case No. 121 of 2015 for the offences instituted under Sections 302, 323, 354 and 504/34 of the IPC.

The prosecution story, in brief, is that the petitioners alongwith other accused persons came variously armed with Lathi, Danda, Tangi to the house of the informant and abused and

Patna High Court Cr.Misc. No.24630 of 2016 (5) dt.08-08-2016 2/2 assaulted with fists, slaps and given a Tangi blow on the neck of the mother-in-law of the informant as a result of which her neck was cut and she died.

It has been submitted on behalf of the petitioners that the petitioner nos. 1 to 4 are in custody since 30.01.2015 and petitioner nos. 5 to 7 are in custody since 06.11.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioners. General and omnibus allegation has been made against the petitioners. No specific injury has been attributed against the petitioners.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghaty, Gaya, in connection with Imamganj P.S. Case No. 121 of 2015.
