The petitioner is languishing in custody since 18.09.2015 in connection with Runnisaidpur P.S. Case No. 364 of 2015 for the offences instituted under Sections 324, 326 and 307 of the IPC. The prosecution story, in brief, is that the petitioner given knife blow causing injury on the neck of the informant. Thereafter, he was admitted to P.H.C. Hospital, Runnisaidpur and from where he was referred to S.K.M.C.H., Muzaffarpur, for better treatment.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.09.2015 and the charge sheet has been submitted in the present case. There is no allegation of

Patna High Court Cr.Misc. No.24759 of 2016 (4) dt.08-08-2016 2/2 tampering of the witnesses alleged against the petitioner. The nature of injury is said to be simple. Hence, no offence under Section 307 IPC is made out.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in connection with Runnisaidpur P.S.
