====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 03-04-2023 Heard Mr. Shakti Suman Kumar, learned Counsel appearing on behalf of the petitioner and Ms. Anita Kumari Singh, learned A.P.P appearing on behalf of the State.

2. The petitioner seeks pre-arrest bail in connection with Trail No. 1435 of 2018 arising out of Complaint Case No. C-2618 of 2014 registered for the offence punishable under Sections 420 and 406 of the Indian Penal Code.

3. Learned Counsel appearing on behalf of the petitioner informed that now the grievance of the Opposite Party No.2 has been redressed and the petitioner has

No.3981 of 2020(7) dt.03-04-2023 2/3 discharged his liability by returning Rs. 1,32,900/- to Opposite Party No.2 and to that effect a mutual agreement has already been signed and Opposite Party No. 2 has acknowledged the amount and now it has been informed that the Opposite Party No. 2 don't want to pursue with the matter.

4. Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

5. Considering the rival submission of the parties, the petitioner is directed to file an affidavit before the Court below along with the joint compromise petitioner. The Court below, after verifying the affidavit as well as joint agreement made by the parties, and if the learned Court below is satisfied, the petitioner is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-14, Motihari in connection with Trial No. 1435 of 2018 arising out of Complaint Case

6. The Court below is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been stated in paragraph No.3 of the bail application, this order will automatically loose its force.
