JUSTICE HARISH KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 19-04-2024 The learned counsel for the petitioner sought for withdrawal of the writ petition. The learned counsel for the respondent objected specifically pointing out that there is a deliberate falsehood made in the writ petition.

2. The learned counsel for the petitioner informs us that as per the instruction of the client, it was averred in paragraph no. 12 that though a show-cause notice dated 05.12.2022 was issued, it was not served upon the petitioner before the order of blacklisting.

3. In the counter affidavit Annexure-R/3E is produced which is the e-mail sent to the e-mail ID of the petitioner herein. The learned counsel submits that he was not informed of the same.

4. However, considering the fact that the petitioner has made a deliberate falsehood we impose a cost of Rs. 5,000/- on the petitioner payable to the Bihar State Legal Services Authority. The said amount will have to be paid within a period of two weeks and if not, the Bihar State Legal Services Authority shall be entitled to proceed for recovery by taking measures similar to recovery of arrears due on land through the District Magistrate, in which event the petitioner shall be liable for the charges incurred for making such recovery, which have to be recovered by the State.

5. Let a copy of this judgment be transmitted to the Member Secretary, Bihar State Legal Services Authority.
