Heard both sides.

The petitioner seeks bail in Bariyarpur P.S. Case No. 94 of 2014, corresponding to Sessions Trial No. 967 of 2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The informant named 8 persons Pochan Yadav, Ramu Yadav, Mithun @ Kare Yadav, Mithu Yadav son of Anju Yadav, Sanjiv Yadav, Sumit Thakur, Krishna Singh and Abhay Yadav. It is alleged that the accused persons entered into his house and on the order of the petitioner Pochan Yadav opened firing hitting the son of the informant on his temple and they all four namely

Patna High Court Cr.Misc. No.7354 of 2015 (3) dt.22-04-2015 2/2 Pochan Yadav, Ramu Yadav the petitioner, Mithun @ Kare Yadav and Mithu Yadav dragged his son outside the house. Learned counsel for the petitioner submits that Mithu Yadav, Sumit Kumar @ Sumit Thakur and Krishna Singh have already been enlarged on bail. Mithu Yadav was directed to be enlarged on bail after framing of charge. The case of the petitioner almost stands on the same footing as the petitioner is not the assailant of the deceased but he is order giver. Learned counsel for the informant did not dispute the fact.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Raj Kumar Srivastava, the learned Special Judge (SC/ST)-cumAdditional Sessions Judge-1, Munger in connection with Bariyarpur P.S. Case No. 94 of 2014, corresponding to Sessions Trial No. 967 of 2014.
