This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 341, 342, 307 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Naya Ram Nagar P.S. (Safiya Sarai O.P.) P.S. Case No. 104 of 2022. As per allegation, four accused persons, including the petitioner, surrounded the informant and the petitioner fired shot which hit his right leg.

The learned counsel for the petitioner has submitted that he is a person of clean antecedent and is in custody since 08.10.2022. As a matter of fact, the informant is a person of

Patna High Court CR. MISC. No.2138 of 2023(3) dt.17-05-2023 2/2 criminal nature and many cases are pending against him. He has submitted further that the injury is not on the vital part which is simple in nature.

Considering the above facts and circumstances, clean antecedent and period of custody, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I Munger in connection with Naya Ram Nagar P.S. (Safiya Sarai O.P.) P.S. Case No. 104 of 2022, subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
