The petitioner apprehends his arrest in connection with C.R. No. 132 of 2019 registered under Sections 120(B), 379, 498(A), 376 of the I.P.C. and section 3⁄4 of the Dowry Prohibition Act pending in the Court of S.D.J.M., Darbhanga. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. Further submission is that petitioner has no criminal antecedent.

Learned A.P.P. appearing on behalf of the State

Patna High Court CR. MISC. No.333 of 2020(5) dt.25-11-2021 2/2 vehemently opposed the prayer of the petitioner by contending that petitioner is husband of the complainant/opposite party no.

2. There is allegation of demand of dowry and torture against this petitioner. There is no chance of settlement in between the parties. Hence, the petitioner does not deserve to be enlarged on anticipatory bail.

Having considered the facts and circumstances of the case and nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
