The petitioner seeks bail in Uchakagaon P.S. Case No. 25 of 2017, instituted for the offence under Section(s) 379 of the Indian Penal Code.
Counsel for the petitioner submits that there is no recovery of alleged Motorcycle from possession of the petitioner. The First Information Report is against unknown. It is alleged in the written report that informant had parked his Honda Shine Motorcycle at his door which was found missing. During investigation, the Motorcycle involved in the instant case was seized by the police from Bush on the basis of confessional statement of co-accused Sanjay Sahni and
Patna High Court Cr.Misc. No.2633 of 2019(2) dt.21-01-2019 2/2 Sahil Rai and, thereafter, Fulwaria P.S. Case No. 37 of 2017 was instituted for the offence under Section 414/34 Indian Penal Code. The FIR accused persons of that case namely, Sanjay Sahni and Sahil Rai in their confessional statement before the polie took the name of petitioner. Petitioner is in custody since 28.11.2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gopalganj, in connection with Uchakagaon P.S.
