2. The petitioner has preferred this application for grant of regular bail in connection with Sugauli P.S. Case No. 471 of 2023 dated 02.11.2023 registered for the offences punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, three unknown miscreants ridden on motorcycle surrounded the son of the informant and committed loot of his motorcycle and snatched his bag containing Rs. 15,000/-, mobile charger and documents. They also fired on the informant causing injury.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.972 of 2025(3) dt.10-04-2025 2/2 this case. Nothing has been recovered from the possession of the petitioner. The petitioner is not named in the FIR. The name of the petitioner has transpired in this case in the confessional statement of the co-accused, Bikesh Kumar. The petitioner has no concern with the alleged offence. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 15.09.2024. The co-accused has been granted regular bail by this Court vide order dated 03.03.2025 passed in Cr. Misc. No. 5776 of 2025.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Motihari, East Champaran in connection with Sugauli P.S. Case No. 471 of 2023.

7. The application stands allowed.
