1. Learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application with respect to petitioner no.1.
2. Permission is accorded.
3. Accordingly, the anticipatory bail application is dismissed as withdrawn as against petitioner no.1.
4. Heard learned counsel for the petitioners as well as learned APP for the State.
5. The petitioner no.2 seek bail in anticipation of her arrest in a case registered for the offences punishable under Sections 304/34 of the IPC and 40 of the Clinical and Establishment.
6. The learned counsel for the petitioners submit that
Patna High Court CR. MISC. No.8998 of 2024(2) dt.05-03-2024 2/3 petitioner is a women and has antecedent of one case. It is next alleged that petitioner has been falsely implicated in the present case at the instance of the informant with an allegation that on recommendation of one 'Asha' worker he took his pregnant wife to City Hospital, Ramgarh where the accused persons including the petitioner were present and they operated his wife who subsequently died. It is further submitted that petitioner is not a doctor, rather is a housewife and her husband is not a doctor, rather is Director of City Hospital, Ramgarh, and the operation was conducted by one Dr. J.P. Yadav. It is next submitted that the informant in order to coerce the accused persons into submission falsely implicated the petitioner who is a housewife and has no concern with the City Hospital, Ramgarh.
7. The learned APP opposes the anticipatory bail application.
8. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is
Patna High Court CR. MISC. No.8998 of 2024(2) dt.05-03-2024 3/3 pending in connection with Ramgarh P.S. Case No.353 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
9. The application stands allowed.
